The right to enjoy things that belong to you

The right to enjoy things that belong to you is part of protocol 1, article 1 of the Human Rights Act.

This right means you should be able to enjoy things that belong to you, including your home and some benefits. Staff in public services are not allowed to control things that belong to you or take them away.

Staff in public bodies can sometimes make decisions or do things that limit this right. Staff in public bodies must make sure that their decision is:

  • Lawful
  • For a good reason
  • Thought about properly
